New Jersey Aggravated Assault Law
Under the New Jersey statute, N.J.S.A. 2C:12-1(b), there are several different scenarios that can give rise to aggravated assault. A person will be guilty of aggravated assault if he or she commits the following acts:
- Aggravated Assault is a 2nd Degree Crime with 5 to 10 years imprisonment if a person attempts to or actually does cause serious bodily injury to another. Also occurs if a person recklessly causes bodily injury under circumstances manifesting extreme indifference to the value of human life.
A 2nd degree crime also occurs if a person causes bodily injury to another during flight from a law enforcement officer, or attempts to elude a law enforcement officer in violation of N.J.S.A. 2CL29-2(b).
- Aggravated Assault is a 3rd Degree Crime with 3 to 5 years imprisonment if a person attempts to cause or intentionally causes bodily injury to another with a deadly weapon.
This offense also occurs if a person attempts to cause or purposely causes significant bodily injury to another person. Also occurs when a person recklessly causes significant bodily injury under circumstances demonstrating extreme indifference to human life.
- Aggravated Assault is a 4th Degree Crime with up to 18 months imprisonment if a person recklessly causes bodily injury to another with a deadly weapon.
