New Jersey Restraining Order Law
If you have violated a temporary or final Restraining Order in New Jersey, you are subject to a criminal contempt charge and are considered in contempt under N.J.S.A. 2C:29-9.
- A person shall serve a minimum of 30 days imprisonment if convicted of a 2nd non-indictable domestic violence contempt offense.
- A person is guilty of a crime of the 4th degree if that person purposely or knowingly violates any provision in an order entered under “Prevention of Domestic Violence Act of 1991” and may be ordered to serve a term of 18 months in jail if convicted
A defendant must receive notice of a temporary or final restraining order before a court can determine that a violation of the order has occurred. This person must have been served with a copy of the restraining order to be accountable for the violation. However, a person cannot claim ignorance to escape accountability for his or her actions in violation of the order.
