New Jersey Simple Assault Law
N.J.S.A. 2C:12-1
A person is guilty of assault if he or she: (i.) Attempts to cause or purposely, knowing or recklessly causes bodily injury to another; or (ii.) Negligently causes bodily injury to another with a deadly weapon; or (iii.) Attempts to put another in fear of imminent serious bodily injury by physical means.
Simple Assault is normally considered a disorderly persons offense and a conviction can result in 6 months imprisonment. However,
- A simple assault committed during a fight or scuffle or entered into by mutual consent is referred to as a petty disorderly persons offense.
- A simple assault on a public official is a Third Degree offense if it results in bodily injury.
- A simple assault on a public official that does not result in bodily injury is a Fourth Degree crime.
A person will also be held criminally liable for “attempted” simple assault, which occurs when an individual attempts to cause bodily injury to another person. This also occurs when a person puts an individual engages in conduct that puts another in fear of serious bodily injury.
