New Jersey Stalking Law
N.J.S.A. 2C:12-10
Under New Jersey law, a person is guilty of stalking only if a reasonable person in the victim’s position would have felt imminently threatened. Stalking is defined as maintaining a close proximity to a person or conveying threats toward a person on two or more occasions. A person is guilty of this crime if he or she purposely and knowingly engages in this sort of conduct, and causes a person to reasonably fear bodily injury to himself or an immediate family member.
Stalking is typically considered a fourth degree offense and can result in up to 18 months in jail in New Jersey. However, stalking may be heightened to a third degree offense and up to 5 years in jail if three circumstances occur:
(1) there was an existing Court Order prohibiting the conduct
(2) the incident is the second or subsequent offense against the suspect with reference to the “victim”; or
(3) stalking occurred while the suspect was in jail or on probation or parole for an indictable offense.
