Ocean County Driving While License is Suspended or Revoked
If you are charged with a license suspension or revocation offense, you are facing serious consequences that could affect your current and future lifestyle. A conviction on this offense can withhold your driving privileges for over a year, which could ultimately affect your career, education, family and social life. For these reasons, the attorneys at our firm provide the best representation and defense for a Driving While License is Suspended or Revoked charge. We understand that there are numerous actions which can lead to a license suspension or revocation including driving without insurance, possession of drugs in the car, reckless driving, speeding, careless driving, failure to report an accident or leaving the scene of an accident, failure to pay child support, failure to pay parking tickets, failure to pay DMV surcharges, and failure to pay a license restoration fee. An individual who operates a motor vehicle while his or her license is suspended or revoked will be charged under N.J.S.A. 39:3-40 and, if convicted, faces an additional 6 months license suspension and is also subject to the following penalties, depending on the circumstances of the offense:
(1) For a first offense, an individual is required to pay a $500.00 fine. If the individual’s license is suspended or revoked due to a DWI conviction, then the driver’s registration is immediately revoked.
(2) For a second offense, an individual is required to pay a $750.00 fine and is subject to at least 1 but no more than 5 days jail time.
(3) For a third or subsequent offense, an individual is required to pay a fine of $1,000.00 and is subject to 10 days jail time.
(4) If an individual operates a vehicle with a suspended or revoked license and is involved in an automobile accident which results in bodily injury to another person, he or she is subject to a minimum of 45 days jail time, but not to exceed 180 days, and an additional suspension of up to 2 years, and a fine of $500.00.
(5) If an individual operates an automobile without a valid license on school property or within 1,000 feet of school property, he or she is subject to an additional suspension of up to 2 years, a $500.00 fine, and 60-90 days jail time; for a second offense, he or she is subject to 120-150 days jail time; for a third or subsequent offense, he or she is subject to 180 days jail time.
(6) If an individual permits another person to operate his or her automobile while knowing that the driver has a suspended or revoked license, he or she is subject to license revocation for a specified period.
