Burglary in Ocean County

An individual can be charged with burglary under N.J.S.A. 2C:18-2, if he or she enters a research facility, structure, or separately secured portion of either, which is not open to the public and the actor has no license or privilege to enter. Moreover, it is a crime for the individual to “surreptitiously remain” in the research facility or structure, with the knowledge that he or she is not privileged or license to enter. Under N.J.S.A. 2C:18-2, if an individual (1) purposely, knowingly, or recklessly inflicts, attempts to inflict, or threatens to inflict bodily injury on another person, or (2) Is armed with or displays what appears to be a deadly weapon or explosives, he or she is guilty of a second degree crime and faces up to 10 years in prison. According to the statute, burglary is typically a third degree crime in any other circumstance, carrying a potential sentence of 5 years jail time.
