An individual can be charged with Credit Card Fraud & Theft, under N.J.S.A. 2C:21-6, if he or she:
(1) Takes or obtains a credit card from the person, possession, custody, or control of another without the cardholder’s consent, or who, knowing that it has been taken, receives the credit card and intends to use it, sell it or transfer it to another person other than the issuer or the cardholder (this is a fourth degree offense, carrying a penalty of up to 18 months jail time)
(2) Is in possession of credit cards issued in the names of two or more other persons or two or more stolen credit cards.
(3) Receives a credit card, knowing that it has been lost, mislaid, delivered under a mistake of identity, and who retains possession with intent to use it, to sell it, or transfer it to another person other than the issuer or the cardholder (this is a fourth degree offense, carrying a penalty of up to 18 months jail time)
(4) Is not the issuer and sells or buys a credit card from a person other than the issuer (this is a fourth degree offense, carrying a penalty of up to 18 months jail time)
(5) Falsely embosses a purported credit card with intent to defraud the issuer (this is a third degree offense, carrying a penalty of up to 5 years jail time)
(6) Receives anything of value knowing or believing that it was obtained by fraudulent credit cards (this is a fourth degree offense, carrying a penalty of up to 18 months jail time)
(7) Knowingly uses any counterfeit, fictitious, altered, forged, lost, stolen, or fraudulently obtained credit card to obtain money, goods, or services, or anything else of value (this is a third degree offense, carrying a penalty of up to 5 years incarceration)
